Cancellation Policy

We want you to be happy with your decision to educate your child at The Dunamis Home-school cooperative. If you are not satisfied with the services any reason, you may cancel.

To cancel, please contact us at cancel@thedunamisschool.vegas and provide your contact information and the reason for the cancellation.

We will not accept cancellation up to two weeks remaining in your payment period.

Once we receive your cancellation, we will process your refund within 10 business days.

Dispute Resolution

If there is a dispute between the member and the cooperative, the parties will first try to resolve the dispute through negotiation.

Mediation

If a dispute arises out of or relating to this Agreement, the parties agree to first attempt to resolve the dispute through negotiation then mediation. Mediation will be conducted by a neutral mediator selected by the parties. The mediation will be conducted in accordance with the procedures set forth in the Nevada Rules of Alternative Dispute Resolution.

If the mediation is unsuccessful, the parties may then pursue other available remedies, including arbitration or litigation.

Arbitration

In the case that mediation should fail in disputes arising out of or relating to this Agreement shall be resolved by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in Las Vegas, Nevada, and the arbitrator shall be a retired judge or magistrate from the state of Nevada.

The parties agree to waive their right to a jury trial and to all other procedural rights that are not specifically provided for in this arbitration clause. The arbitrator’s decision shall be final and binding on the parties and may be entered as a judgment in any court of competent jurisdiction.

Jurisdiction

If the parties are unable to resolve their dispute through negotiation, mediation, or arbitration, the dispute will be resolved in the courts of the jurisdiction where the seller is located.

Severability

If any provision of this dispute resolution clause is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
